Overview
If you purchased or acquired in the United States for your own use a new Toshiba Satellite 1800 notebook computer, a proposed nationwide class action settlement (“Settlement”) could affect your legal rights. You may be entitled to file a claim for monetary recovery.

A proposed Settlement has been reached in the lawsuit. If the Court approves the Settlement, owners of Satellite 1800 notebook computers (“Satellite 1800s”) containing a central processing unit of 1 GHz or faster may be entitled to Settlement benefits.

Class members who experienced certain performance issues after a BIOS update was installed, and then took their notebook to Toshiba or a Toshiba authorized service provider for repair of these issues, will be eligible to receive their choice of a:

$125 cash payment
OR $150 credit voucher for use at www.toshibadirect.com.
Class members who experienced certain performance issues after a BIOS updated was installed, but did not take their notebook to Toshiba or a Toshiba authorized service provider for repair for these issues, will be eligible to receive a:

$40 credit voucher for use at www.toshibadirect.com.
How to Claim Benefits
If you are a Class member and wish to participate in the Settlement, you must file a valid Claim Form no later than May 5, 2009. Claim Forms can be downloaded or submitted online on this website, or can be requested by calling toll-free 1 (800) 265-4629. You may also write to Toshiba Satellite 1800 Settlement, c/o The Garden City Group, Inc., P.O. Box 91097, Seattle, WA 98111-9197.

Exclusions and Objections
The deadline to exclude yourself from the settlement or object to or comment in support of the settlement was February 2, 2009.

Fairness Hearing
The Honorable Carolyn B. Kuhl of the Superior Court of California for the County of Los Angeles will hold a hearing on February 24, 2009, at 10:00 a.m., at the Central Civil West Courthouse, Courtroom 323, 600 South Commonwealth Avenue, Los Angeles, California 90005, to consider whether to grant final approval to the proposed Settlement and Class Counsel’s request for attorneys’ fees and costs in an amount not to exceed $650,000. You have a right to appear at the hearing, although you do not have to.
